Is weed legal in New York?

The Marijuana Regulation and Taxation Act (MRTA) legalizes cannabis for adults 21 years of age or older. The legislation creates a new Office of Cannabis Management (OCM) governed by a Cannabis Control Board to oversee and implement the law. The MRTA modifies criminal violations and penalties relating to the sale and possession of cannabis.

The limits of MRTA are as follows:

Adults 21 years of age and older may possess up to 3 ounces of cannabis and 24 grams of concentrated cannabis (like vaporization oil or an edible).


If you are in NYC attempting to consume marijuana, smoking or vaping is permitted anywhere that smoking is allowed. Edibles can be consumed almost anywhere unless you are planning on operating a vehicle. If you are too inebriated please call a uber, lyft, or yellow cab.
